Urgent: Resolution Required for Leaky Bathtub Issue - Compliance with NHBC Buildmark Policy and Consumer Code for Home Builders

I bought a house from Lovell Homes in Dec. 2016 and around Nov. 2018, I contacted Lovell regarding a leak issue around my bathtub and at the time their maintenance operative quickly came over and I thought the leak got effectively repaired but, much my dismay as the photos confirm the leak got camouflaged and the leak has spread to the wall and to the lower floor causing major damage to the side wall.

I have tried to get Lovell Homes to fix a leaky bathtub issue on more than 2 occasions but Lovell Homes has closed the investigation without any explanation. This bathtub is beggining to concern me as I can see moisture or mildew buiild up on the walls on the floor below the bathroom and it is near the house's main electrical fuse box. I am rather concerned that this micro leak from the bathtub will cause an electrical fire.

This is the latest email sent to them:

Dear Lovell Homes Customer Service,

I hope this email finds you well, but I must express my utmost disappointment and frustration with the way Lovell Homes has handled the persistent issue of a leaky bathtub in my home, purchased in 2016. The repeated refusal to address this problem and the consequent damage it has caused to my property are entirely unacceptable and are tarnishing the image of a company that should be committed to its customers and its own policies.

As a responsible homeowner, I have always taken pride in maintaining my property in the best possible condition. However, since the faulty bathtub repair performed by your company, the situation has escalated into a nightmare. The substandard repair work has led to water leakage, which has now caused significant damage to the surrounding area and other parts of my home.

I want to emphasize that I have been patient and understanding throughout this process, expecting Lovell Homes to honor the 10-year NHBC Buildmark policy, as well as the Consumer Code for Home Builders, which exist to protect customers like myself from such situations. It is disheartening to witness the lack of commitment in living up to these essential guarantees.

Given the severity of the problem and the fact that it is a result of a previous incorrect repair carried out by your company, I insist that you take immediate and appropriate action to rectify the situation. Failing to do so will leave me with no choice but to pursue legal action to seek resolution and justice.

I must also express my profound disappointment in the way Lovell Homes has handled the matter thus far. The absence of effective communication, coupled with the refusal to take responsibility, has caused unnecessary stress and hardship for my family. We have had to endure the consequences of your company's negligence and lack of accountability for far too long.

Please be informed that I am seeking a comprehensive resolution that not only addresses the leaky bathtub but also compensates for the damages caused to my home. I will hold Lovell Homes accountable for any additional costs, including legal fees, that may arise due to your company's reluctance to act responsibly.

I trust that you will take this matter seriously and initiate immediate steps to inspect and repair the faulty bathtub. Furthermore, I request that you provide a detailed plan of action and a timeline for resolving this issue, along with a commitment to compensate for the damages and stress that I have had to endure.

I eagerly await your prompt response and an amicable resolution to this unfortunate situation. Let me emphasize once more that my primary intention is to reach a fair resolution and avoid further escalation.

Sincerely,

ILIDIO JOANES
