Dispute details:

Work stopped due to non-compliance and poor workmanship

The contractor was brought in to do a series of jobs on the house. They completed some but when the windows were installed, they did not comply to conservation windows standard. The contractor repaid the money for the windows but with this issue and others such as poor workmanship we said that we will not go ahead with the rendering of the front of house and the skylight in the kitchen along with some other works that totalled £32,000. The contractor has over GBP10,000 of our money that had been paid diligently as payment for all works. I am seeking this money to be paid back to us. The contractor has now put in accounts where he is charging for things that were not done and he is seeking to keep all of this money.

Attempts to resolve dispute:

I have called and emailed many times. A WhatsApp on the 29th of Feb said the accounts would be settled over the weekend, so due Monday 4th. The latest update was an email on March 15th when accounts were finally sent. These contained many new charges and did not reflect anything that had been previously discussed. I have the full list of all the activities agreed and all the paperwork and photographs to show the issues mentioned above. I would like to settle this matter amicably and promptly.

Update 09/04/24

The contractor continues to ignore my calls and emails even though he himself said we would need to go to mediation. He sent this on 21/03/24 (See Below)

“ Dear Matt
I do not think it is possible for us to agree settlement ar this stage.
I am sending the papers to Alpha Legal who will hopefully write to you by tomorrow
As a contract exists between us we both need to follow the process.”

I have also no idea who Alpha Legal are and repeated requests from the contractor remain unanswered.
The contractor is registered under the name “Pete Hanks Building services.” He is not Pete Hanks; his name is Ashok Kumar Malik. Pete Hanks no longer has any affiliation with the company.

On the Pete Hanks website it says they have industry affiliations. I have checked all the building affiliations in the UK, and they are not affiliated to any of them. They were affiliated to the British Institute of interior design but their partnership with them lapsed in 2023.

I have asked continuously for their building accreditation, but the contractor refuses to respond. Our home has been left with a hole in the kitchen and major work to be completed in another room.

Sadly, my next step will need to be one of a legal avenue.
