Formal complaint about International Mandatory Training Course Fee
I am writing to make a formal complaint against the director. My complaint is that they failed to make refunds of payments that we made on behalf of our clients for International Mandatory Training course.
The payments were made for Seven (7) of our clients at £400.00 each. Earlier correspondences were sent to her on this subject matter vide emails dated July 21, 2022, July 23, 2022, August 3, 2022, August 11, 2022, August 12, 2022, August 19, 2022, August 29, 2022, and August 31, 2022. Please find attached copies of such correspondence.
My complaint is that the International Mandatory Courses were paid to Gain Healthcare so that our clients could take the training and get employed in the UK afterward on passing their interview, this was however not possible because the training course program was canceled after payments were made.
We have reached out to Gain Healthcare occasionally requesting for refunds on behalf of our clients since they didn’t participate in the training course but to no avail.
They later asked that we fill up return forms for each of our clients attaching proof of payments and dates on which payments were made for the clients which we did. As stated on the forms, we were to get payments within 28 working days which was due on the 12th of December 2022 but didn’t get any response from the agency.
We have reached out to Mrs. Olinda and her team concerning the same issue and haven’t gotten any response till date.
It is important to state that we have received complaints and threats from clients for whom payments have been made and we are constrained to take all necessary steps under the appropriate laws (Misrepresentation, Consumer Rights and Contract etc) to brief a legal practitioner to proceed with an action for recovery.
In my view, Gain Healthcare should first of all reply our email and then go ahead with disbursement of the fee to the account that is filled out in the refund form alongside with an apology and compensation for personal injury, losses, legal cost & expenses on behalf of our client for breach of contract - warranty, misrepresentation for failing to disclose information and duty of care to customers.
I understand that you are required to respond formally to my complaint. I shall follow up this letter if I do not hear back from you by the 26th of January 2023.
