Failure to fix leaking ceiling in flat under terms of service charge obligations
I purchased a new build flat in Leeds (56 Leylands House, Magbgate, Leeds LS9 7EA) from the KMRE Group in May 2019. In March 2020 the tenant reported a leak in the ceiling in one of the bedrooms. The plaster board is now peeling off the ceiling and during heavy rain we have water coming through the ceiling.
Attempts to resolve dispute:
I contacted KMRE Group in July 2020 requesting a repair under the terms of the builder guarantee as well as obligations under the building service charge which KMRE Group collects via a subsidiary company - Niche Homes. There then followed a series of e-mails/phone calls where I kept chasing up on progress. KMRE Group claimed to have fixed the leak in February 2021. The leak re-appeared in November 2021. I have sent numerous mails, phone calls and 2 formal letters (August 2022) to KMRE Group and the Managing Director of the company - no reply received,. The letters were sent via recorded delivery and both were received by KMRE Group and signed for. It is now nearly a year since the leak was allegedly fixed but there is no resolution and I am getting radio silence from KMRE Group despite me having paid all service charges to date. Whenever I phone the company the reception desk takes the message, assures me someone will reply and I then get no response.
