Failure to complete service Level 3 design consultation and quotation

On 28 July 2023 we approached Abel Landscaping to enquire about providing a ramp with handrails to replace our old steps and provide easier, better and safer access to the home.

Abel Landscaping responded offering four levels of service for providing quotes.

On 4 August 2023 Abel Landscaping were paid £300 (£250 plus VAT) for a service Level 3 design consultation and quote for a residential disability access ramp. With a Level 3 design consultation the service offered is "we give you different design options and work with you until we find a design that works in every way including one that's fits your budget."

The service subsequently provided included only one rudimentary design option/sketch which was not considered a suitable or acceptable design for our needs. There was no further design development or progress as was originally promised, despite our attempts to keep them engaged and work with them. Nor did we at any stage receive a quotation for this initial design or any other alternative design, "that fits our budget". Clearly this falls way short of the service Level 3 design consultation that was offered and paid for.

On 11 September 2023 we wrote to Abel Landscaping (the Company) politely requesting a refund as we didn't believe that £300 worth of professional design consultation service plus quotation had been provided. The Company became even more unresponsive.

Months went by without even the courtesy of a response.

We persisted and on 16 November a representative of the Company agreed to a partial refund as an acceptable solution, or a quotation had not been provided and therefore the full service Level 3 had not been achieved or completed.

Despite repeated follow up emails and contact via their company website, as of today 12 February 2024, we still have not received this refund.

When our wasted time, effort and cost over the past 6 months is taken into account, we would suggest that a full refund of £300 would be considered appropriate compensation.

Attempts to resolve dispute:

Response to accusation (by accused):

Hi , we agreed a partial refund as he didn’t provide a second quote , he did come & spend time giving an initial quote with the design option he felt was feasible for the property , we understand that not all companies charge for surveys or quotes , but there are lots who do , we spend time with customers, measuring up giving different options & ideas & Mr Gaughan wasn’t happy with proposed design , which is fair enough , that’s why we offer different options till the customer is happy , so he left it with just the 1 design option , saying all that we did agree a partial refund & still want to uphold that ! We have sent our sincere apologies to Mr Gaughan personally & on here too , we came into some financial difficulty due to unforeseen circumstances & was unable to pay not just him , but other things too suppliers , but we do want to honor him , so please can you let him no we are in a better position as of this week to pay him , a partial refund of £150 .
