Defrauded by a Cowboy builder - PJDBUILDERS BORDEN LTD & IDS BUILDERS LIMITED

I compiled a list of builders that have traded and posted their EOY accounts for at least 15 years. IDS Builders came up in the list. I sent an email to: enquiries@idsbuilders.co.uk on 03 November 2022 at 02:12. On 7 Nov 2022, at 15:52, I received a response from builders@idsbuild.co.uk signed by the Director of the company. He subsequently visited my property. The architectural plans for the permitted work under the Planning Permission were made available to the builder. Following the visit, he provided me with an estimate for the job which I agreed to. I signed the Federation of Master Builders contract for the job – it was insured by Aviva Insurance. The builder billed me £1000 towards the Insurance Policy. He commenced the project on 12 December 2022 and abandoned the job on 14 April 2023. In that period, he only one workman at the site, at any given time. Altogether, his workmen spent less than 25 days working at the property.

I met up with the builder at the property on 14 April 2023. I observed that the roof was constructed poorly, causing slant of the hip, and that a course of tiles was missing from one side of the roof to the other and that roof tiles were spaced widely apart. I highlighted these concerns with the builder. At which point, he told me there is nothing wrong with the roof and how it was tiled. He told to take a look at my neighbour’s. I questioned why the builder had started laying the polystyrene board for the underfloor heating without addressing the below ground drainage issues. You claimed you checked the foul drainage and concluded there is no issue. He became angry saying my complaints were baseless. He asked his workman to pack up the tools and he threatened to strip out the work he had done to that point.

I paid the builder £35000 plus £7000 VAT, totalling £42000. There is a myriad of issues with the work that the builder carried out on my property. It has since been established that the roof was constructed poorly, causing slant of the hip. A course of tiles was missing from one side of the roof to the other and the roof tiles were spaced widely apart. The existing lead has been nailed through the front and done poorly. The Fascia and soffits have been done poorly. The Velux window was poorly cut in and in need of repair. Also, it has since been established that the builder did not address the below ground drainage issues.

An Expert Witness Report in regard to Material and workmanship and breach of contract has been carried out. It has been determined that all the works are defective and would have to come out. The foundations do not comply with Building Regulations and do not comply with engineer’s designs that was specified for foundations on shrinkable clay. The roof was not built in accordance with the engineer’s designs. There is flitch beam (two joists bolted together through a steel plate) but the roof structure is not supported by this beam. The beam is hung on a main flitch beam running parallel to the front of the property by means of a double joist hanger. The flange to the top of the joist hanger has not been nailed to the supporting flitch beam.

The builder demanded that I honour the last invoice that he raised. He filed a Claim against me which I defended in Court. He owes me £11,560 in Legal Costs for this Claim. My Lawyers have written several emails to the builder, Aviva Insurance, DAS Law (Legal Claim) and Federation of Master Builders (Liability) regarding the Litigation matter. The builder has refused to provide my Lawyers with the contact details of the Solicitor that is acting for him. The builder confirmed in his correspondence with my Lawyers that he had lodged the claim with Aviva on 10th October 2023, 18th October 2023 and 30th October 2023. But to date, my Lawyers have not received any evidence of this. I have a Counter Claim that the builder has refused to authorise Aviva Insurance to accept. The remediation costs and legal costs are projected to be in the region of £180,000.

The builder has made an attempt to dissolve the company that I found him through - IDS BUILDERS LIMITED 04148448. I have raised a objected to the dissolution. I have also noted that the builder has since brought down the website (https://www.pjdbuilders.co.uk) for PJDBUILDERS BORDEN LTD (14388837).

Attempts to resolve dispute:

The builder has refused to provide my Lawyers with the contact details of the Solicitor that is acting for him, and he has refused to authorise Aviva Insurance to accept a Counter Claim from my Lawyers.

Response to accusation (by accused):

This claim is vehemently opposed on all fronts.The original objection placed against IDS builders is vexatious and without merit as the contract signed by Mackenzie is with pjdbuilders Borden ltd.Mackensie has never had any agreement with IDS.Contrary to what she rambles on about this is a live action and my insurers will respond substantively in due course as she has been informed. This claim is without any merit and is defamatory and should be removed.I am taking legal advice on this as wrongful accusation of fraud on a public portal i assume IS a very serious offence.I actually thought it was a scam upon first looking this am.
